Pioneer Labs ("Pioneer Labs", "we", or "us") is committed to protecting the privacy of our customers, and we take our data protection responsibilities with the utmost seriousness.
This Privacy Notice describes how Pioneer Labs collects and processes your personal data through the Pioneer Labs websites and applications that are referenced in this Privacy Notice. Pioneer Labs refers to an ecosystem comprising Pioneer Labs websites (whose domain names include but are not limited to www.Pioneer Labs.com/en), mobile applications, clients, applets and other applications that are developed to offer Pioneer Labs Services, and includes independently-operated platforms, websites and clients within the ecosystem (e.g., Pioneer Labs's Open Platform, Pioneer Labs Launchpad, Pioneer Labs Labs, Pioneer Labs Charity, Pioneer Labs DEX, Pioneer Labs X, JEX, and fiat gateways).
This Privacy Notice applies to all Personal data processing activities carried out by us, across platforms, websites, and departments of Pioneer Labs.
To the extent that you are a customer or user of our services, this Privacy Notice applies together with any terms of business and other contractual documents, including but not limited to any agreements we may have with you.
To the extent that you are not a relevant stakeholder, customer, or user of our services, but are using our website, this Privacy Notice also applies to you together with our Cookie Notice.

The Pioneer Labs group is made up of different legal entities. In this regard, the controller of your personal data is the legal entity that determines the "means" and the "purposes" of any processing activities that it carries out.
For global users, i.e. users that are not registered with a local regulated exchange, Nest Services Limited (a company incorporated under the laws of Vietnam with registration address at 17th Floor, Vincom Center Building, No. 72 Le Thanh Ton, Ben Nghe Ward, District 1, HCMC) is your operating entity and data controller, as of 23 November 2024.
2. What Personal Data does Pioneer Labs collect and process?
Personal data is data that identifies an individual or relates to an identifiable individual. This includes information you provide to us, information which is collected about you automatically, and information we obtain from third parties.
Information you provide to us. To open an account and access our services, we'll ask you to provide us with some information about yourself. This information is either required by law (e.g., to verify your identity and comply with "Know Your Customer" obligations), necessary to provide the requested services (e.g., you will need to provide your email address in order to open your account), or is relevant for certain specified purposes, described in greater detail below. In some cases, if we add services and features you may be asked to provide us with additional information.
Failure in providing the data required implies that Pioneer Labs will not be able to offer you our services.

3. Why does Pioneer Labs process my personal data? Which legal bases are we relying on for our collection and processing of your personal data?
Our primary purpose in collecting personal data is to provide our services in a secure, efficient, and smooth way. We generally use your personal data to deliver, provide, operate, our services, and for content and advertising, and for loss prevention and anti-fraud purposes. Below you'll find an explanation on how we use Automated individual decision-making, including profiling. Pioneer Labs does not rely solely on automated tools to help determine whether a transaction or a customer account presents a fraud or legal risk.

To verify your identity We are generally required to collect various pieces of personal information to properly identify or verify your identity and comply with other specific anti-money laundering ("AML") or sanctions laws/regulations (e.g. funds transfer rules). If you are not a user and you sign up for one of our events, we will collect the following information: name, email, company, title, industry, address, phone number, whether meal preferences, social media domain and the like. (ii) in some cases you might pay to attend an Event. You may be asked to provide more information when signing up for an event. (iii) if you are a presenter at one of our events, we will collect information about you including your name, employer and Contact Information, and photograph, and we may also collect information provided by event attendees who evaluated your performance as a presenter. We may also make and store a recording of your voice and likeness in certain instances. (iv) Some of our events are sponsored. Pioneer Labs may provide an attendee list to sponsors, co-sponsors and exhibitors of our events. Pioneer Labs may also allow sponsors, co-sponsors, exhibitors or other third parties relevant for the organisation of the event to send you material by mail once per sponsored event, in which case Pioneer Labs engages a third-party mailing house and does not share your mailing address directly with the sponsor/exhibitor. If you do not wish to have your information included in an attendee list or to receive information from sponsors, co-sponsors and/or exhibitors, you can express your preferences when you register for events or you may contact Pioneer Labs directly at dpo@Pioneer Labs.com. We do give attendees a choice not to receive marketing messages from the sponsor or from Pioneer Labs. (iv) To provide you with information about the event(s) which you have registered, such as event updates and possible changes, cancellations or similar information. Further details may be as follows: When you decide to participate in an event or act as a presenter for the event, we rely on your consent to process your personal data for attendance to an event. When you consent to processing your personal data for a specified purpose, you may withdraw your consent at any time and we will stop processing your personal data for that purpose. If you are a presenter at one of our events, we may also like to take photographs, and make and store a will collect recording of your voice and likeness in certain instances. In these situations Pioneer Labs relies on a legitimate interest basis for collecting, storing and processing this personal data. 4.Can Children Use Pioneer Labs Services?
Pioneer Labs does not allow anyone under the age of 18 to use Pioneer Labs Services and we do not knowingly request or collect any information about persons under the age of 18. If you are under the age of 18, please do not provide any personal information to Pioneer Labs Services.
If a User or Customer submitting personal information is suspected of being younger than 18 years of age, Pioneer Labs will require the relevant Customer or User to close his or her account, and will take steps to delete the individual's information as soon as possible.
5. What About Cookies and Other Identifiers?
We use cookies and similar tools to enhance your user experience, provide our services, enhance our marketing efforts and understand how customers use our services so we can make improvements. 6. How and Why We Share Your Personal Data?
We may share your Personal Data with third parties (including other Pioneer Labs entities) if we believe that sharing your Personal Data is in accordance with, or required by, any contractual relationship with you (including Pioneer Labs Terms & Conditions) or us, applicable law, regulation or legal process. When sharing your Personal Data with other Pioneer Labs entities, we will use our best endeavours to ensure that such entities are either subject to this Privacy Notice, or follow practices at least as protective as those described in this Privacy Notice. For example, depending on where you reside and the entity responsible for running KYC checks. For more information please refer to Section 1.
We may also share personal data with the following persons or in the following circumstances:
Third Party Independent Controllers
Within the context of the services rendered by Pioneer Labs, some of the third party service providers may process your personal data as independent data controllers for their own purposes which may include but are not limited to:
- compliance with legal or regulatory obligations under applicable laws;
- prevention of criminal activity, fraud (including impersonation fraud), money laundering or other illicit activities by checking data against records of confirmed or suspected illegal activities; in connection with this purpose, the service provider may carry out profiling, statistical analysis and analytics in AML/CFT tendency using machine learning
- enhancing the effectiveness and quality of its fraud prevention services;
- user onboarding as the third party's own client or customer;
- to use the services of financial institutions for fiat related transactions - user identification necessary to respond to data subject requests;
- establishment, exercise, or defense of legal claims (if applicable).
The service providers rely on legal bases for data processing as disclosed in their respective privacy notices, accessible from their websites. Your personal data will be processed no longer than necessary for the above processing purposes and will be retained according to the service providers' retention schedules. You can request for more information about the identity of the third party service providers and their processing activities by contacting Pioneer Labs (see Section 10).
7. International transfers of Personal Information
To facilitate our global operations, Pioneer Labs may transfer your personal information outside of the European Economic Area ("EEA"), UK and Switzerland. The EEA includes the European Union countries as well as Iceland, Liechtenstein, and Norway. Transfers outside of the EEA are sometimes referred to as "third country transfers".
We may transfer your personal information to our Affiliates, third-party partners, and service providers based throughout the world. In cases where we intend to transfer personal information to third countries or international organisations outside of the EEA, Pioneer Labs puts in place suitable technical, organizational and contractual safeguards (including Standard Contractual Clauses), to ensure that such transfer is carried out in compliance with applicable data protection rules.
We also rely on decisions from the European Commission where they recognise that certain countries and territories outside of the European Economic Area ensure an adequate level of protection for personal information. These decisions are referred to as "adequacy decisions".
8. How Secure is My Information?
We design our systems with your security and privacy in mind.
